СОГЛАШЕНИЕ
1. Общие положения
1.1. Настоящее Пользовательское соглашение (далее — «Соглашение») регулирует отношения между Правообладателем и пользователем мобильного приложения «Рядом» (далее — «Приложение»).

1.2. Правообладатель:
Физическое лицо, зарегистрированное в соответствии с законодательством Республики Казахстан.

1.3. Используя Приложение, Пользователь подтверждает, что:
ознакомился с условиями Соглашения;
принимает их в полном объёме;
осознаёт и принимает ответственность за свои действия.

2. Предмет соглашения
2.1. Приложение предоставляет Пользователю доступ к функционалу, связанному с:

поиском единомышленников;
организацией прогулок и активности;
информационными и мотивационными материалами.
2.2. Приложение не является медицинским сервисом, не предоставляет медицинских консультаций и не заменяет обращение к специалистам.

3. Регистрация и аккаунт
3.1. Для использования отдельных функций Приложения может потребоваться регистрация.
3.2. Пользователь обязуется предоставлять достоверную информацию.
3.3. Пользователь несёт ответственность за сохранность данных своего аккаунта.

4. Права и обязанности сторон
Пользователь обязуется:
использовать Приложение законно;
не нарушать права третьих лиц;
не размещать незаконный, оскорбительный или вводящий в заблуждение контент.

Правообладатель вправе:
изменять функционал Приложения;
приостанавливать доступ при нарушении Соглашения;
обновлять условия Соглашения без предварительного уведомления.
5. Платные функции (если применимо)
5.1. В Приложении могут быть доступны платные функции или подписки.
5.2. Оплата осуществляется через Apple App Store или Google Play.
5.3. Возврат средств регулируется правилами соответствующих платформ:

6. Ограничение ответственности
6.1. Приложение предоставляется «как есть».

6.2. Правообладатель не гарантирует:
достижение конкретных результатов;
бесперебойную работу Приложения;
соответствие ожиданиям Пользователя.
6.3. Пользователь использует Приложение на свой страх и риск.

7. Персональные данные
7.1. Обработка персональных данных осуществляется в соответствии с Политикой конфиденциальности.
7.2. Используя Приложение, Пользователь даёт согласие на обработку своих данных.

8. Применимое право
8.1. Настоящее Соглашение регулируется законодательством Республики Казахстан.

9. Заключительные положени
9.1. Если какое-либо положение Соглашения будет признано недействительным, остальные положения сохраняют силу.
9.2. Актуальная версия Соглашения всегда доступна в Приложении.

These Terms of Use (“Terms”) govern your access to and use of the mobile application “Рядом” (the “App”), operated by an individual entrepreneur based in the Republic of Kazakhstan (“we”, “us”, “our”).

By downloading, accessing, or using the App, you agree to be bound by these Terms.
If you do not agree with these Terms, please do not use the App.

1. Purpose of the App
The App is designed to help users:

find like-minded people for walking and physical activity,
improve motivation for a healthy and active lifestyle,
access informational and motivational content related to movement and well-being.
The App does not provide medical, psychological, or professional advice.

2. Eligibility
You must be at least 18 years old to use the App.
By using the App, you confirm that you meet this requirement.

3. Health Disclaimer
All content in the App is provided for informational purposes only.

The App is not a medical service and does not replace professional medical consultation, diagnosis, or treatment.

You use the App at your own risk.
Before starting any physical activity, consult a qualified healthcare professional if needed.

4. User Responsibilities
You agree:

to use the App lawfully and respectfully,
not to misuse the App or attempt to interfere with its operation,
not to upload or share harmful, offensive, or misleading content.
You are fully responsible for your interactions with other users.

5. Payments and Subscriptions (if applicable)
Some features of the App may be offered on a paid basis.
All payments are processed through Apple App Store or Google Play.
We do not store or process payment data.
Subscription management and refunds are handled according to the policies of Apple or Google.

6. Intellectual Property
All content, design, logos, texts, and materials in the App are owned by us or used with permission.
You may not copy, distribute, modify, or use any part of the App without prior written consent.

7. Limitation of Liability
To the maximum extent permitted by law:

we are not liable for any injuries, losses, or damages resulting from use of the App,
we are not responsible for user behavior or offline meetings arranged through the App.
The App is provided “as is”, without warranties of any kind.

8. Termination
We reserve the right to suspend or terminate access to the App at any time, without notice, if these Terms are violated.

9. Changes to These Term
We may update these Terms from time to time.
Continued use of the App after changes means you accept the updated Terms.

10. Governing Law
These Terms are governed by the laws of the Republic of Kazakhstan, without regard to conflict of law principles.
